Adolphus Law PLLC is a New York professional limited liability company. We do not publish an office address and we do not take walk-in inquiries.

Preparation

Before you write

  • Do not use a work email address, a work computer, or a work phone.
  • Do not discuss it publicly, including on social media, in a forum, or with a reporter. The False Claims Act contains a public disclosure bar, and public disclosure can affect whether a case can be brought at all.§ Source, statute, see sources page
  • Do not wait to be certain. The statute has a first-to-file bar and a limitations period, and both reward moving early.§ Source, statute, see sources page
  • You can ask questions before you name anyone, including your employer.

What to send in a first message

A first message is most useful if it answers four things.

  • What you saw, and how you saw it.
  • Roughly when, and whether it is still happening.
  • What program was billed. Medicare fee-for-service, Medicare Advantage, Part D, Medicaid, TRICARE, or something else.
  • Why it looked wrong to you.

If you do not know one of these, say that instead of guessing.

Handling records

What not to send

Do not send confidential or privileged information until the firm confirms in writing that it can receive it.

Information sent before an engagement is in place may not be treated as confidential and may not be protected by the attorney-client privilege. A first message is not privileged and this page is not a secure channel.

  • No patient names, patient identifiers, or medical records.
  • No documents you are not authorized to have. Do not copy, remove, download, or forward material in violation of a workplace policy, an agreement, or a court order. Describe what exists and where it is kept. We will discuss how it should be handled.
  • No material filed under seal in another case, and no grand jury material.
  • No originals of anything. Do not remove a record from where it belongs.
  • No trade secrets or privileged material of a party you do not represent.
  • No recordings made without knowing whether the recording was lawful where it was made.

Describe a record before sending it. We will discuss whether you may possess it and how it should be handled. Privacy explains why ordinary email is not a secure channel.

Intake

What happens next

01
We read it. We do not promise a response time.
02
If it is outside what the firm does, we say so.
03
If it fits, we ask to speak. Before that conversation we will tell you how to reach us securely.
04
If we go further, we investigate before anything is filed. Most matters stop here, and we will tell you why.
05
Nothing binds either of us until there is a signed written engagement agreement.
