Legal notices

These notices apply to the entire site.

Required label

Attorney advertising

This website is a communication about legal services offered by Adolphus Law PLLC. New York's rules governing lawyer advertising treat a communication of this kind as an advertisement and require it to be labeled as one. It is labeled on every page of this site, above the masthead, where it can be read without scrolling.

The label is not a formality the firm resents. A reader is entitled to know, before reading a word, that the party describing the work is the party that wants the work.

Engagement

Contacting the firm creates no attorney-client relationship.

Contacting Adolphus Law PLLC does not create an attorney-client relationship. An attorney-client relationship is formed only by a signed engagement agreement.

This is true however you reach the firm. Sending an email, calling the telephone number published on this site, following a link marked contact, or reading any page here does not make the firm your lawyer. Until an engagement agreement is signed, the firm has not agreed to act for you, and it may decline the matter for any reason or for none.

First contact

Confidentiality and privilege

Do not send confidential or privileged information until the firm confirms in writing that it can receive it.

Information sent before an engagement is in place may not be treated as confidential and may not be protected by the attorney-client privilege.

A first message is not privileged. This site is not a secure channel, and email is not a secure channel. The firm cannot check whether it has a conflict of interest until it knows who is involved, and information sent before that check cannot be unsent.

This matters more here than on most law firm websites, because this site invites people to describe suspected fraud at the organizations they work for. The safe first message describes what exists and where it lives. It does not enclose it.

What not to send sets out the rest, including documents you are not authorized to have, material filed under seal, and patient records.

Outcomes

Prior results

Past results do not guarantee future outcomes.

Every case turns on its own facts, its own record, and its own law. Nothing on this site is a prediction, an estimate, or an implication of the outcome of any matter, and the firm makes no promise about a result, a timeline, a recovery, a relator's share, or a response time.

This site publishes no client, no matter, no settlement, no verdict, no recovery, and no representative matter. That is deliberate. A law firm's public claims should be verifiable, and claims of that kind are not.

Attribution

The statistics on this site are government enforcement data.

Every figure published on this site comes from a public document issued by a federal body: the United States Department of Justice, the Centers for Medicare & Medicaid Services, the Department of Health and Human Services Office of Inspector General, or the Government Accountability Office.

Recoveries, settlements, judgments, filings, and investigations reported by the Department of Justice describe past enforcement by the United States. They are not results of this firm. They are not a forecast of results in any matter. They do not describe any case the firm has handled, and they should not be read as a suggestion that any particular matter would produce a comparable figure.

Citing an agency's published documents is not a relationship with that agency. Adolphus Law PLLC is not affiliated with, endorsed by, appointed by, or acting on behalf of the Department of Justice, the Centers for Medicare & Medicaid Services, the Office of Inspector General, the Government Accountability Office, or any other government body.

Verification

Sources and figures

Every number used anywhere on this site is listed on the sources page with the document it comes from, the fiscal or calendar year it describes, and a link to the agency's own publication where the document states one. If a number is not on that page, it is not on this site.

Government reporting is revised. Where a figure is superseded, the sources page is updated and the page that used it is updated with it.

Improper payments are not fraud. The Centers for Medicare & Medicaid Services states that improper payment measurement is not a measure of fraud. An improper payment is a payment that did not meet program payment requirements, and it may be an overpayment, an underpayment, or a payment for which there was not enough documentation to tell. This site uses those estimates to describe the scale of the payment-integrity problem, and never as an estimate of fraud.

Reach

Jurisdiction and admissions

Adolphus Law PLLC is a New York professional limited liability company organized for the practice of law. Stephen Klapper is admitted to practice in:

  • New York
  • Connecticut
  • United States Court of Appeals for the Second Circuit
  • Supreme Court of the United States

New York attorney registration number 6069512.

The False Claims Act is a federal statute and cases under it are brought in federal courts throughout the United States. That does not mean the firm is admitted everywhere, and nothing on this site should be read to say so. The firm does not hold itself out as practicing in any jurisdiction in which it is not admitted, and it does not seek to represent anyone in a jurisdiction where doing so would be improper.

Admission in a particular court may be sought for a particular matter. Where that is necessary, it is discussed before an engagement, not assumed.

Accountability

Responsibility for this site

Stephen Klapper is responsible for the content of this site.

The site is published by Adolphus Law PLLC, Bronx, New York. It is a solo practice, and every matter is led by Stephen Klapper. If anything on this site is unclear, incomplete, or wrong, the firm would rather hear about it than not.
